These Terms of Service ("Terms") govern your use of the website clarksu.com (the "Site") and any purchases made from Clarksu, which is operated by CLARK SUMMITEDGE SOLUTIONS LLC ("we", "us", or "Clarksu"). By accessing or using the Site and/or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or place an order.

Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use this Site and buy products. By placing an order, you represent and warrant that you meet these eligibility requirements.

Orders, Availability & Acceptance

All orders placed via the Site are subject to acceptance by Clarksu. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product or service availability, errors in product or pricing information, fraud, or problems identified by our payment processor.

When you place an order, you will receive an email acknowledging receipt of your order. This acknowledgement does not constitute acceptance of your order. A contract between you and Clarksu for the purchase of products will only be formed when we send you a shipment confirmation email for those products.

Product Descriptions & Accuracy

We strive to provide accurate information about our products (features, specifications, images, dimensions, and safety information). However, we do not warrant that product descriptions, pricing, or other content on the Site are error-free, complete, or current. In the event of an obvious error (for example, a product listed at an incorrect price), we may cancel the order or contact you for instructions.

We do not make unrealistic performance claims and avoid misleading statements in compliance with Google Merchant Center policies.

Pricing, Payment & Taxes

Payment Method: All purchases on this Site are processed through PayPal. By placing an order, you authorize PayPal to charge the total amount to your PayPal account or the funding source linked to your PayPal account.

Pricing: Prices displayed on the Site are quoted in U.S. dollars. We take reasonable care to ensure that prices are accurate but reserve the right to change prices at any time prior to accepting your order.

Taxes: Currently, no sales tax is charged at checkout. If tax requirements change, we will update this page and collect applicable taxes as required by law.

Shipping, Delivery & Risk of Loss

Shipping, delivery timing, and related costs are described in our Shipping Policy. Title and risk of loss for items purchased pass to you when the carrier accepts possession of the shipment. Delivery estimates are provided for convenience and are not guaranteed.

Returns, Refunds & Cancellations

Our Returns & Refunds terms are set out in the Return & Refund Policy. Key points: eligible returns must be initiated within 30 days after delivery, items must be unused and in original packaging, customers pay return shipping, refunds are processed to the original PayPal payment method (processing typically takes 2 business days after approval), and we do not offer exchanges. Do not send returns to the company address unless explicitly instructed.

Warranties & Product Claims

Products may include manufacturer warranties. Clarksu does not provide additional warranties beyond those expressly stated on the product page or in accompanying documentation. Any warranty claims should follow the instructions in the Warranty Policy or the manufacturer’s instructions.

Intellectual Property

All content on the Site — including text, images, logos, designs, product listings, and code — is owned or licensed by Clarksu and protected by intellectual property laws. You may view and print pages from the Site for your own personal use, but you may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARKSUMMITEDGE SOLUTIONS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THE PRODUCTS PURCHASED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Governing Law & Dispute Resolution

These Terms and any claim or dispute arising under or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Kentucky, U.S.A., without regard to its conflict of law provisions. You agree that any dispute will be resolved exclusively in the state or federal courts located in Jefferson County (Louisville), Kentucky, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with any policies posted on the Site (including our Shipping Policy, Privacy Policy, and Returns & Refunds Policy), constitute the entire agreement between you and Clarksu relating to your use of the Site and supersede any prior agreements.
